1. Agreement to Terms

By accessing our website or engaging 1st Caliber Marketing ("Company," "we," "us") for services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

1st Caliber Marketing provides done-for-you lead generation services for residential roofing contractors, including but not limited to:

  • Google and Facebook advertising campaign management
  • Dedicated landing page creation and hosting
  • Automated lead follow-up via SMS and phone
  • Appointment scheduling and calendar booking
  • Monthly performance reporting
  • Dedicated account management

Services are provided on a market-exclusive basis — one roofing contractor per geographic market. Specific deliverables and scope are outlined in your individual service agreement.

3. Payment Terms

Payment terms are specified in your individual service agreement. General terms include:

  • Fees are billed monthly in advance on the agreed billing date
  • Payment is due within 5 business days of invoice
  • Ad spend budgets are billed separately and passed through at cost — we do not mark up ad spend
  • Late payments may result in a pause in services until the account is current
  • All fees are in US dollars

4. Commitment Period and Cancellation

We require a 90-day initial commitment to give the system sufficient time to optimize and deliver consistent results. After the initial 90-day period, the agreement converts to month-to-month.

To cancel month-to-month services, provide written notice at least 14 days before your next billing date. Notice can be sent to ben@1stcalibermarketing.com.

Upon cancellation:

  • Ad campaigns will be paused at the end of the current billing period
  • Your market exclusivity will be released
  • Landing pages hosted by us will be taken offline within 30 days
  • No refunds are issued for the current billing period

5. Client Responsibilities

To receive full benefit of our services, you agree to:

  • Respond to booked appointments in a timely manner
  • Provide accurate business information for ad campaigns and landing pages
  • Maintain an active ad spend budget as agreed
  • Notify us promptly of any changes to your service area or availability

6. SMS Terms

By providing your phone number and engaging our services, you consent to receive SMS messages from 1st Caliber Marketing. SMS communications may include:

  • Service updates and account notifications
  • Appointment confirmations and scheduling
  • Lead activity alerts
  • Performance reporting summaries

SMS consent is not a condition of purchase. You may receive our services without consenting to SMS messages.

Message and data rates may apply. Message frequency varies.

7. Intellectual Property

Ad creative, landing page copy, and campaign materials produced by 1st Caliber Marketing remain our intellectual property during the term of service. Upon full payment and termination of the agreement, you may request a transfer of landing page copy and ad creative assets for your own use.

8. Results Disclaimer

We stand behind our system and the results our clients have achieved. However, we cannot guarantee specific lead volumes, revenue outcomes, or return on ad spend. Results depend on factors including your market, ad spend budget, response time to leads, and close rate. Past client results shared on our website are real but not a guarantee of future performance.

9. Limitation of Liability

To the maximum extent permitted by law, 1st Caliber Marketing's total liability for any claim arising from our services is limited to the total fees paid by you in the 30 days preceding the claim. We are not liable for indirect, incidental, or consequential damages of any kind.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of our services after changes are effective constitutes acceptance.
